These Terms of Service constitute a legally binding agreement (the “Agreement”) between You (the “Advertiser” or “User” or “You” or “Your”) and patpat.lk (the “Site” or “patpat.lk” and shall include the said patpat.lk its owners or Parent Company or Subsidiaries and affiliates) governing your access and use of the Site.
Definitions
“Content” means the advertising content, text, images, graphics, video uploaded and/or provided by You for inclusion on the Site and any other additional information required from You by the Site from time to time.
By accessing or browsing or surfing or using this website, you confirm your understanding of the Terms and Conditions. If you do not agree to these Terms and Conditions of use, you shall not use this website. The Site reserves the right to change, modify, add, or remove portions of these Terms and Conditions of use at any time. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions of use regularly for updates. Your continued use of the Site following the posting of changes to these Terms and Conditions of use constitutes your acceptance of those changes.
You are required to submit a valid, accurate and correct name, email address and a mobile number (“Personal Information”) before You are allowed to post advertisements or allowed to access and use the Site. The Personal Information and Content provided shall be publicly displayed and shall be considered as public information. You specifically agree and understand that the Personal Information and Content shall not be considered as confidential information. You also agree and understand that patpat.lk shall not be responsible or liable for the accuracy of the Personal Information and Content contained on the Site and/or for any issues, claims, damages or losses arising from the Personal Information or Content being publicly available and/or for any issues, claims, damages or losses arising from any inaccuracies or misrepresentations contained in the Personal Information or Content.
By uploading and/or providing Personal Information and Content on to the Site and/or to patpat.lk, You agree and hereby specifically consent that the Site and patpat.lk shall have the right to use and process the Personal Information and Content (collectively referred to as “Personal Data”) uploaded and/or provided by You for any purpose whatsoever for the Purpose (as defined herein below) in accordance with the applicable law. You shall have the right to withdraw Your Consent at any point and in such event, patpat.lk and/or the Site shall have the right to suspend or terminate Your account. However You specifically acknowledge and agree that such withdrawal shall not affect the lawfulness of any processing of Personal Data taken place prior to such withdrawal.
General
You and the relevant Advertisers would be responsible for ensuring that the Content uploaded and/or provided for inclusion on the Site complies with all applicable laws.
The Users are permitted to send email to the Advertiser directly or through the Site and the Site shall not be responsible and/or liable in any way for such communications between a User and an Advertiser.
You are solely responsible for all Your activities on the Site, keeping Your passwords and other account identifiers safe and secure and You shall access and use the Site at Your own volition and at Your own risk. You must notify patpat.lk of any unauthorized use of Your password or account. The Site nor patpat.lk shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with the failure to comply with this section.
Advertisers can post the relevant advertisements free of charge. The Users shall use the Site free of charge. You understand and acknowledge that patpat.lk is only a facilitator of the platform and accordingly neither patpat.lk nor its’ owners have any control whatsoever of any transaction between Advertisers and Users or third parties. Accordingly neither patpat.lk nor the Site shall be responsible in any way whatsoever including in respect of payments made to or by Advertisers and/or Users and/or any third parties.
Content provided on the Site is solely for informational purposes. Product representations expressed on the Site are those of the Advertisers or vendors and are not of patpat.lk. patpat.lk is neither involved nor has any control whatsoever of the Content of the advertisements, the products or services being sold through the advertisements, or actual transactions between Advertisers, Users or any third parties through the advertisements. Therefore You understand and agree that patpat.lk has no control over the quality, safety or legality of the products or services offered, the truth or accuracy of the Content of the advertisements. Accordingly patpat.lk shall not bear any responsibility or liability whatsoever to mediate any such dispute between Advertisers, Users or any third parties You agree and understand that patpat.lk cannot be held liable for any claim of loss, damages or wrongdoing on behalf of either the Advertisers, Users or any third parties.
You guarantee that Your Content or advertisement does not violate any copyright, intellectual property rights or other rights of any person or entity, and agree to release and indemnify patpat.lk its owners or Parent Company or Subsidiaries and Affiliates from all obligations, liabilities and claims arising in connection with the access and use of the Site Patpat.lk and the Site shall have the absolute discretion to reject any advertisement or the Content or a portion of the advertisement or a portion of the Content, to edit or amend or modify the advertisement or the Content without stating any reasons whatsoever.
The Site uses cookies, which means that You must have cookies enabled on Your Device in order for all functionality on the Site to work properly. Cookies are tiny text files which identify Your Device to patpat.lk server as a unique user, when a user visits certain pages on the Site and they are stored by the user's Internet browser on the user's computer's hard drive.
You agree and acknowledge that patpat.lk does not guarantee continuous or secure access to the Site and the Site is provided "as is" and as and when available.
You agree and acknowledge that patpat.lk does not guarantee that the access to and use of the Site will be uninterrupted and error free, or the data will not be lost, or that defects in the Site will be corrected.
You agree and acknowledge that the pages contained in the Site may contain technical inaccuracies and typographical errors and that patpat.lk accepts no responsibility or liability for keeping the information in these pages up to date or liability for any failure to do so.
Copyright
You hereby grant patpat.lk, a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute the Personal Data or incorporate such Content into any form, medium, or technology now known or later developed.
You agree and understand that patpat.lk is entitled to use the Personal Data provided by You to provide services, resolve disputes and troubleshoot problems, to encourage safe trading, improve the services and inform users about services and updates, to communicate marketing promotions , to provide Lending facilities and for business purposes or promotions or marketing or product development of patpat.lk (the “Purpose”) and You agree to receive promotional emails from the Site. You hereby give Your consent to patpat.lk to disclose the Personal Data to any party whatsoever in order to facilitate the Purpose.
The material (including the content, and any other content, software or services) contained on the Site are the property of patpat.lk and/or third party licensors. Any intellectual property rights, such as copyright, trademarks, service marks, trade names and other distinguishing brands on the Site are the property of patpat.lk and/or third party licensors. No material on the Site shall be copied, reproduced, republished, installed, posted, transmitted, stored or distributed without express written permission from patpat.lk and/or third party licensors
Any material, except for Personal Data that is submitted to the Site and/or provided, including but not limited to, questions, reviews, comments, and suggestions will become the sole and exclusive property of patpat.lk and shall not be returned. When any comments or reviews are posted to the Site, the person postings such comments or reviews grants the right to patpat.lk to use the name in connection with such review, comment, or other content.
Lease Your Vehicle Option
On every advertisement patpat.lk reserves the right and has the discretion to post the approximate installment the user has to pay, if the user is willing to take a lease or hire purchase facility from the Parent Company or its subsidiaries or the owners of www.patpat.lk.
In the event, the user opts to take the lease or hire purchase facility the user has to click on the "Lease Your vehicle" link and shall provide the necessary details requested in the link which shall include but shall not be limited to the name, address, telephone/mobile number and email address. The Officer of patpat.lk or its Parent Company or its subsidiaries or the owners shall have the right to call the user in relation to proceed with the Leasing or Hire Purchase Facility.
However patpat.lk or the Parent Company or its subsidiaries or the owners shall not guarantee that a Leasing or Hire Purchase facility shall be provided to the User or shall not guarantee that the Leasing or Hire Purchase facility shall be given at the approximate installment posted near the advertisement.
Watermarks
All images on the Site shall be watermarked at the discretion of patpat.lk which prevents the images to be used for other purposes, without the consent of the Advertiser or patpat.lk.
Offences or illegal usage or conduct or acts not accepted by patpat.lk include but are not restricted to acts and offences which are prescribed as being unlawful by any written law.
patpat.lk shall report any act which is in violation of the law to any relevant authorities or shall cooperate in any investigation conducted by the relevant authorities. The identity of Advertisers and/or Users may be determined, for example, by the Internet Service Provider. IP addresses may also be registered in order to ensure compliance with the terms and conditions.
You shall undertake to hold patpat.lk together with its owners, Parent Company, Subsidiaries, affiliates and administrators, harmless and indemnified against all suits, actions, proceedings, charges, damages, demands, costs, losses and expenses which may be brought by any third parties and/or Users and/or Advertisers.
Links to third party websites
The Site may contain links or references to other websites ('Third Party Websites'). patpat.lk shall not be responsible for the contents in Third Party Websites. Third Party Websites are not investigated or monitored. In the event the user decides to leave the Site and access Third Party Sites, the user does so at his/her own risk and patpat.lk shall have no responsibility and liability in respect of the same.
patpat.lk does not provide any guarantees that Advertisers have been truthful or accurate in their representations, advertisements, they have items in stock, will accept the return of an item or product, or provide any refunds, or the completion of a successful transaction
Disclaimer
patpat.lk shall assume no responsibility what so ever for the use of patpat.lk and disclaims all responsibility for any injury, claim, liability, or damage of any kind resulting from or arising out of or any way related to (a) any errors on patpat.lk or the Content, including but not limited to technical errors and typographical errors, (b) any third party web sites or content directly or indirectly accessed through links on the Site, (c) the unavailability of the Site, (d) your use of the Site or the Content, or (e) Your use of any equipment (or software) in connection with the Site.
Indemnification
You agree to indemnify patpat.lk, its owners, its’ Parent Company, its’ Subsidiaries and affiliates as well as its officers, directors, employees, agents, from and against all losses, expenses, damages and costs, including attorney's fees, resulting from any violation of this Terms and Conditions (including negligent or wrongful conduct).
Governing Law
This Agreement shall be governed by and construed and interpreted in accordance with the laws of Sri Lanka and the parties will submit all disputes arising under or in connection with this Agreement to the exclusive jurisdiction of the Courts of Sri Lanka.
Termination
If You are dissatisfied with the use of the Site or if You do not agree with any part of this Agreement or the service, You expressly agree that your sole and exclusive remedy is to discontinue using the Site.
