These Terms of Service constitute a legally binding agreement (the “Agreement”) between You (the “Advertiser” or “User” or “You” or “Your”) and patpat.lk (the “Site” or “patpat” or “Our”) and shall include the said patpat.lk its owners or Parent Company or Subsidiaries and affiliates) governing Your access and use of the Site.

Definitions

“Advertiser” means a user who posts an advertisement on patpat.lk

“Account” means the user account created for the purpose of ad posting

“Content” includes the advertising content, text, images, graphics, video uploaded and/or provided by You for inclusion on the Site and any other additional information required from You by the Site from time to time.

“Device” means the electronic device used to access patpat.lk app or web

“patpat” means the solutions provider

“Site” means patpat.lk and shall be hosted or run by patpat

“User” means anyone who accesses the platform

By accessing, browsing, surfing, using the Site, You confirm Your understanding of these Terms and Conditions. If You do not agree to these Terms and Conditions of use, You shall not access or use the Site. The Site reserves the right to change, modify, add, replace or remove portions of these Terms and Conditions of use (“Updates”) at any time. Updates will be effective when posted on the Site with no other notice provided. It shall be Your responsibility to check these Terms and Conditions of use regularly for Updates. Your continued use of the Site following the posting of or effecting the Updates to these Terms and Conditions of use constitutes Your acceptance of those Updates.

You are required to create an Account by submitting a valid, accurate and correct name, email address mobile number and a password and any other information which patpat may require from time to time (“Personal Information”) before You are allowed to access and use the Site. You may also access and/or use the Site by accessing the Site via SMS OTP or by using your Facebook or Google Account. Accessing and/or using the Site via SMS OTP or by using your Facebook or Google Account shall be done at Your own risk and patpat shall not be liable and and/or responsible in any way to You. The information provided in the advertisements including contact numbers and locations you post and Content provided shall be publicly displayed and shall be considered as public information. You specifically agree, understand and consent to, that the information provided in the advertisements including contact numbers and locations you post and Content shall not be considered as confidential information. You also agree, understand and consent that patpat shall not be responsible or liable for the accuracy of the Personal Information and Content contained on the Site and/or for any issues, claims, damages or losses arising from the Personal Information or Content being publicly available and/or for any issues, claims, damages or losses arising from any inaccuracies or misrepresentations contained in the Personal Information or Content .

By uploading and/or providing Personal Information on to the Site and/or to patpat, You agree and hereby specifically consent that the Site and patpat shall have the right to use and process the Personal Information uploaded and/or provided by You for for the Purpose (as defined herein below) in accordance with the applicable law. You shall have the right to withdraw Your Consent at any point and in such event, patpat and/or the Site shall have the right to suspend or terminate Your account. However You specifically acknowledge and agree that such withdrawal shall not affect the lawfulness of any processing of Personal Information taken place prior to such withdrawal.

General

You and/or Advertiser (as applicable in each instance) would be responsible for ensuring that the Content uploaded and/or provided for inclusion on the Site complies with all applicable laws.

The Users are permitted to send email to the Advertiser directly or through the Site and the Site shall not be responsible and/or liable in any way for such communications between a User and an Advertiser

You are solely responsible for all Your activities on the Site, keeping Your passwords and other account identifiers safe and secure and You shall access and use the Site and upload content into the same at Your own volition and at Your own risk. You must notify patpat of any unauthorized use of Your password or account. The Site nor patpat shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with the failure to comply with this section.

Advertisers can post the relevant advertisements free of charge. Advertisers may also have the option to pay for an upgraded account subject to the Advertiser paying to patpat the relevant charges for the same. In the event of a failure to make the payments patpat shall have the right to terminate, suspend or revert Your Account back to the free version. The Users shall use the Site free of charge.

You understand and acknowledge that patpat is only a facilitator and accordingly neither patpat nor its’ owners have any control whatsoever of any transaction between Advertisers and Users or third parties. Accordingly, neither patpat nor the Site shall be responsible in any way whatsoever including in respect of payments made to or by Advertisers and/or Users and/or any third parties. Users are responsible for the content and compliance of their listings with applicable laws and patpat's posting guidelines.

Content provided on the Site is solely for informational purposes. Product representations expressed on the Site are those of the Advertisers or vendors and are not of patpat. patpat is neither involved nor has any control whatsoever of the Content of the advertisements, the products or services being sold through the advertisements, or actual transactions between Advertisers, Users or any third parties through the advertisements. Therefore, You understand and agree that patpat has no control over the quality, safety or legality of the products or services offered, the truth or accuracy of the Content of the advertisements. Accordingly, patpat shall not bear any responsibility or liability whatsoever to mediate any such dispute between Advertisers, Users or any third parties You agree and understand that patpat cannot be held liable for any claim of loss, damages or wrongdoing on behalf of either the Advertisers, Users or any third parties.

You guarantee that Your Content or advertisement does not violate any copyright, intellectual property rights or other rights of any person or entity, and agree to release and indemnify patpat its owners or Parent Company or Subsidiaries and Affiliates from all obligations, liabilities and claims arising in connection with the access and use of the Site.

patpat and the Site shall have the absolute discretion to reject any advertisement or the Content or a portion of the advertisement or a portion of the Content to edit or amend or modify the advertisement or the Content without stating any reasons whatsoever.

The Site uses cookies, which means that You must have cookies enabled on Your Device in order for all functionality on the Site to work properly. Cookies are tiny text files which identify Your Device to patpat server as a unique user, when a user visits certain pages on the Site and they are stored by the user's Internet browser on the user's computer's hard drive.

You agree and acknowledge that patpat does not guarantee continuous or secure access to the Site and the Site is provided 'as is' and as and when available.

You agree and acknowledge that patpat does not guarantee that the access to and use of the Site will be uninterrupted and error free, or the data will not be lost, or that defects in the Site will be corrected.

You agree and acknowledge that the pages contained in the Site may contain technical inaccuracies and typographical errors and that patpat accepts no responsibility or liability for keeping the information in these pages up to date or liability for any failure to do so.

Copyright

You hereby grant patpat, a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute the Personal Information and Content or incorporate such Content into any form, medium, or technology now known or later developed.

You agree and understand that patpat is entitled to use the Personal Information and Content provided by You to provide services, resolve disputes and troubleshoot problems, to encourage safe trading, improve the services and inform users about services and updates, to communicate marketing promotions, to provide Leasing and Hire Purchase facilities, and for business purposes or promotions or marketing or product development of patpat (the “Purpose”) and You agree to receive promotional emails from the Site. You hereby give Your consent to patpat to disclose the Personal Information and Content to any party whatsoever in order to facilitate the Purpose.

The material (including the content, and any other content, software or services) contained on the Site are the property of patpat and/or third party licensors. Any intellectual property rights, such as copyright, trademarks, service marks, trade names and other distinguishing brands on the Site are the property of patpat and/or third party licensors. No material on the Site shall be copied, reproduced, republished, installed, posted, transmitted, stored or distributed without express written permission from patpat and/or third party licensors.

Reviews and Ratings by Verified Customers and Blog

Only Users who have purchased a product or service through patpat (“Verified Customers”) may submit reviews and ratings for that specific product or service. By submitting a review, you represent that your feedback is based on your genuine experience with the item purchased.

patpat does not endorse or guarantee the accuracy, usefulness, or authenticity of any review and expressly disclaims any liability arising from or related to reviews posted by users. Users are solely responsible for the content of their reviews, and any reliance on such content is at your own risk. patpat may, at its discretion, remove reviews that violate content policies, but assumes no obligation to do so. Such removal, if and when done, does not signify that patpat is in any way or manner responsible and/or liable for the relevant content.

The blog is maintained by authorized personnel of patpat for educational and informational purposes. The opinions expressed are those of the respective authors and do not represent patpat’s official position. patpat does not assume liability for inaccuracies or omissions and disclaims all responsibility for reliance on blog content. In the event of any claim being made against patpat which relates to or arises from any content posted by any You, You agree that you will hold patpat harmless from such claim. Content is provided 'as is,' and Users are advised to independently verify any information before acting upon it.

Any material, except for Personal Information that is submitted to the Site and/or provided, including but not limited to, questions, reviews, comments, content uploaded to the blog and suggestions will become the sole and exclusive property of patpat and shall not be returned. When any comments or reviews are posted to the Site, the person posting such comments or reviews grants the right to patpat to use the name in connection with such review, comment, or other content. patpat shall not in any way or manner be liable or responsible in any way or manner in respect of such material and all responsibility and liability in respect of the same shall be with the person who posted the relevant material.

Buyer-Seller Chat Functionality

patpat provides an onsite messaging system to facilitate communication between buyers and sellers, but is not a party to those communications and assumes no responsibility for the content, conduct, or outcome of any such interactions. Users are solely responsible for the messages they send and receive through the patpat chat system. patpat disclaims all liability for any disputes, misunderstandings, or issues that arise between users through this communication channel. Although patpat reserves the right to monitor or retain chat communications for compliance purposes, it is under no obligation to do so and does not guarantee the accuracy, safety, legality, or appropriateness of any message exchanged. patpat is only a facilitator of the communication that is carried on the onsite messaging system and does not take any liability of responsibility to any loss or damage caused as a result of the messages exchanged on the system. By use of the platform the user takes all responsibility and liability for the same and You agree to hold patpat harmless against any claim made against it by a third party as a result of your use of the onsite messaging system

Lease Your Vehicle Option

On every advertisement patpat reserves the right and has the discretion to post an approximate installment, You as a User has to pay, if You are willing to take a lease or hire purchase facility from patpat’s Parent Company or its subsidiaries or affiliates or the owners of patpat.

In the event, You as a User opt to take the lease or hire purchase facility, You have to click on the 'Lease Your Vehicle' link and You shall provide the necessary details requested in the link which shall include but shall not be limited to the name, address, telephone/mobile number and email address. An Officer of patpat or its Parent Company or its subsidiaries shall have the right to call You in relation to proceed with the leasing or hire purchase facility.

However, patpat shall not guarantee that a leasing or hire purchase facility shall be provided to You or shall not guarantee that the leasing or hire purchase facility shall be given at the approximate installment posted near the advertisement.

Green Financing Hub

patpat may showcase green financing products, including but not limited to electric vehicle leases and renewable energy loans, from patpat’s Parent Company or its subsidiaries or affiliates or the owners of patpat. patpat acts solely as a publisher of this content and not a financial service provider as defined by the Finance Business Act No. 42 of 2011. All financing arrangements are between the user and the respective financial institution. patpat disclaims all liability for the terms, approval, and fulfillment of such products.

Gold Loan Calculator

The Gold Loan Calculator is a non-binding tool provided for informational purposes only. It does not constitute a financial offer or advice. patpat does not collect or retain personal data through the use of this tool. Users acknowledge that any reliance on the output of the calculator is solely at their own risk, and patpat disclaims all responsibility for decisions made based on these estimations.

Instant Credit Decision

Users applying for instant credit decisions consent to the processing and secure transmission of personal information (e.g., NIC, phone number, income) to patpat’s Parent Company or its subsidiaries or affiliates or the owners of patpat. You agree and understand that patpat does not evaluate or approve credit requests and You understand that patpat has no control w

Watermarks

All images on the Site shall be watermarked at the discretion of patpat, which prevents the images to be used for other purposes, without the consent of the Advertiser or patpat.

patpat is only a facilitator of the patpat platform and thus would not be liable for any Offences or illegal usage or conduct or acts carried out by users of the platform. Offences or illegal usage or conduct or acts not accepted by patpat include but are not restricted to acts and offences which are prescribed as being unlawful by any written law in Sri Lanka. patpat may inform the relevant law enforcement authorities of any illegal usage or conduct or acts carried out by users of the platform in compliance with the obligations cast upon patpat by law.

patpat shall report any act which is in violation of the law to any relevant authorities or shall cooperate in any investigation conducted by the relevant authorities. The identity of Advertisers and/or Users may be determined, for example, by the Internet Service Provider. IP addresses may also be registered in order to ensure compliance with the terms and conditions.

You shall undertake to hold patpat together with its owners, Parent Company, Subsidiaries, affiliates and administrators, harmless and indemnified against all suits, actions, proceedings, charges, damages, demands, costs, losses and expenses which may be brought by any third parties and/or Users and/or Advertisers arising and/or relating from your use and/or association with the patpat platform or any feature relating to the platform.

Links to third party websites

The Site may contain links or references to other websites and/or vendors and/or Advertisers ('Third Party Advertisers'). Third Party Advertisers are not investigated or monitored by patpat. patpat shall not be responsible for the contents in Third Party Advertisers. In the event the User decides to leave the Site and access Third Party Advertisers, You as the user would do so at Your own risk and patpat shall have no responsibility and/or liability in respect of the same.

patpat does not provide any guarantees or take any responsibility or liability that Third Party Advertisers have been truthful or accurate in their representations, advertisements, they have items in stock, will accept the return of an item or product, or provide any refunds, or the completion of a successful transaction.

Banner Module (Third-Party Advertising)

patpat provides predefined banner spaces for advertisements from Third Party Advertisers (as defined herein). These advertisements are not endorsements by patpat, and we do not guarantee the accuracy, reliability, legality, or quality of any content or services offered therein. Third Party Advertisers are not investigated or monitored by patpat. patpat shall not be responsible for the contents in Third Party Advertisers. By interacting with such advertisements, users acknowledge that patpat is not a party to any subsequent transactions or communications. Under applicable law, patpat disclaims all liability for loss, damage, or claims arising from reliance on or dealings with Third Party Advertisers.

Disclaimer

patpat is only a facilitator and accordingly shall assume no responsibility whatsoever for the use of patpat and disclaims all responsibility for any injury, claim, liability, or damage of any kind resulting from or arising out of or any way related to (a) any errors on patpat or the Content, including but not limited to technical errors and typographical errors, (b) any third party web sites or content directly or indirectly accessed through links on the Site, (c) the unavailability of the Site, (d) your use of the Site or the Content, or (e) Your use of any equipment (or software) in connection with the Site.

Indemnification

You agree to indemnify patpat, its owners, its Parent Company, its Subsidiaries and affiliates as well as its officers, directors, employees, agents, from and against all losses, expenses, damages and costs, including attorney's fees, resulting from any violation of this Terms and Conditions (including negligent or wrongful conduct) and/or resulting from Your use of the patpat platform and/or any component of the platform.

Governing Law

This Agreement shall be governed by and construed and interpreted in accordance with the laws of Sri Lanka and the parties will submit all disputes arising under or in connection with this Agreement to the exclusive jurisdiction of the Courts of Sri Lanka.

Termination

If You are dissatisfied with the use of the Site or if You do not agree with any part of this Agreement or the service, You expressly agree that your sole and exclusive remedy is to discontinue using the Site. patpat reserves the right to terminate this Agreement and terminate your Account and access to the Site anytime without notice.

Privacy Policy

In order for the Site to provide a useful service, it is important for patpat to collect, use, and share personal information. You specifically consent to such collection, use and sharing of personal information in order for the Site to provide the service, which is used by You.

patpat shall collect and store the name, telephone number, email address and other contact information, financial information, computer sign-on data, statistics on page views, traffic to and from patpat and response to advertisements and other information, including but not limited to users' IP address and standard web log information.

patpat may disclose personal information to respond to legal requirements and to respond to claims that a posting or other content violates other's rights, or to protect anyone's rights, property, or safety.

You agree to receive marketing communications about goods and services offered through the Site.

You shall not use the Site or communication tools to harvest addresses, send spam or otherwise breach the Terms and Conditions of Use or Privacy Policy.

If at any time the user or advertiser wishes to modify or alter personal information or images, the user or advertiser shall log into the Account and do the needful.

The Site makes use of Display Advertising, and uses Remarketing technology with Google Analytics to advertise online. Third-party vendors, including Google, may show ads of patpat on various websites across the Internet, using first-party cookies and third-party cookies together to inform, optimize, and serve ads based on past visits to patpat.

You can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using the Ads Preferences Manager.

Location Detection

Where User consent is granted under applicable data protection laws, including the General Data Protection Regulation (GDPR) and the Sri Lankan Personal Data Protection Act, patpat may collect and use location data via browser, mobile, or device settings. Users consent to the processing of this data for features such as geo-targeted listings under the Privacy Policy. patpat disclaims responsibility for inaccuracies in location data and reminds users that they may disable this feature through their device settings at any time. By enabling this feature, You hereby give your express and specific consent for patpat to process such location data.

Save Search Feature

Users may save specific search queries with selected filters. Saved searches are linked to user accounts and processed in accordance with patpat Privacy Policy. While patpat strives for accuracy, we do not guarantee the future availability or consistency of saved listings. Users are responsible for verifying updated listing data. patpat disclaims all liability for losses resulting from reliance on saved searches.

SMS and Email Marketing

By accessing and/or using the Site, You expressly consent to receiving marketing communications via SMS and email. Users may opt out at any time through provided unsubscribe links or by updating preferences in their Account. patpat ensures all personal data is processed in accordance with Our Privacy Policy, and Users have the right to access, rectify, or erase their data as provided for by law.

Trilingual Support

patpat offers content in Sinhala, Tamil, and English. While efforts are made to ensure consistent and accurate translations, patpat does not guarantee linguistic or semantic accuracy. In case of discrepancies, the English version shall prevail. patpat disclaims all liability for misunderstandings arising from translated content.
